As far as I know they've not explained which toilet you can let someone use if you're unable to confidently determine their biological sex? Eg you say one thing they say another and you don't have evidence either way
Can you let them use any toilet at all if you don't have unisex?

Previous case law extended this to trans men easily, just presuming that women was used because that's who usually gets pregnant, but that obviously the intent was for it to be unlawful to fire anyone for being pregnant. This is also assuming unified meaning which is dubious.

It makes most sense for the pregnancy, maternity and breastfeeding provisions to apply to anyone who is pregnant, has recently given birth, or is breastfeeding, rather than on the basis of sex. Given that's what they're supposed to protect.

I don't think even most GC people think there's a compelling argument for legally preventing me from setting up a club for gay/bi men that includes trans men. No one is forced to join!

if it would have been impossible to come to the conclusion in FWS before Brexit that is a problem on its own. it seems bad if the meanings of a law can completely invert without anyone noticing or intending it to happen!

I can see an objection on sex discrimination if the outcome is that there is a men's and a unisex? That is objectively unequal. And removing urinals to install more cubicles is expensive remodelling most places can't do immediately.

Think that position has mostly evaporated post FWS tbh. Even banenoch thought gender neutral is fine if you only have space for 1 toilet.
She clearly doesn't think it's okay to rebadge a multi cubicle unit as unisex and has no answers for what a business with that setup should do.

Imo this is all relatively uncontested and avoiding the fact that she doesn't have an answer to what a service that currently has only gendered facilities that aren't self contained rooms should do.

Is that necessary for misgendering to be unlawful? If trans people are being referred to in ways that don't match our preferences, and everyone else is being referred to in ways that do match their preferences that should be indirect discrimination? Without a specific status needing to be acquired
