A few Republican lawmakers and staffers have asked for my advice on college athletics issues over the last few months. Every time, I tell them that one of the biggest things they can do is make sure the Federal Govt continues to publish accurate data. We're at risk of losing it.

Of note, the case does not seek to enjoin the settlement, but instead prevent the NCAA from "allocating an unjust portion of the settlement to South Dakota." The court held that the questions raised by those claims do not raise a federal question, and thus can be heard in federal court.

This is a loss for the NCAA, who hoped to keep this case in federal court (and likely seek to consolidate it with House in ND Cal). They'll instead have to defend against the state's breach of contract and breach of fiduciary duty claims in the Brookings County Circuit Court.

If you are a business and want to have currently enrolled student athletes in your ads/promos, you must enter into a name, image, likeness activity contract in order to avoid an NCAA amateurism rules violation that may impact their eligibility.
