Yep, in our Oath it is implied that orders given SHOULD BE legal, NOT that they ALWAYS ARE. Thats why it goes on to specify according to regulations and the UCMJ. Why bother stating that in our Oath if it wasn’t of utmost importance.

I do not see how any judge would even allow the case to stand. He stated what’s in the Oath of Enlistment. Soldiers are to support and defend the Constitution, to obey orders aka lawful orders of those appointed over us. It is implied that they SHOULD give lawful orders NOT that they ALWAYS do.
