The documents released by the Office of the Ombudsman under Jesus Crispin Remulla also include earlier rulings from former Ombudsman Conchita Carpio-Morales for context.

The 2019 ruling granted Villanueva’s Motion for Reconsideration, reversing the 2016 decision and dismissing the case entirely.

“Accordingly, the present case against them is hereby DISMISSED.”

The Ombudsman also cited findings from the NBI showing that Villanueva’s signatures in the questioned documents were forgeries.

The 2019 decision found no adequate evidence linking Villanueva to any embezzlement or misuse of funds.

“There is no adequate evidence on record showing that Villanueva was actually involved in the embezzlement of ₱9,700,000.00 in public funds.”

The questioned funds came from the 2008 PDAF allocation of Villanueva as CIBAC Party-list Representative.

The ₱9.7M was intended for agricultural livelihood projects implemented through the NGO Aaron Foundation Philippines, Inc. (AFPI) and National Agribusiness Corporation (NABCOR).

Villanueva filed his Motions for Reconsideration in November and December 2016, contesting a previous decision that found him and others guilty of grave misconduct and serious dishonesty.

Ore Asia mining already took action to the damage check dam by blocking the waste water from coming to the river, which in the end is not enough, according to Gov. Daniel Fernando.

Mayor Bong Alavarez of San Miguel Bulacan also file a case against OAMDC, as well as Cong. Mark Chill Viologo hold a meeting together with Igg. Adrian Escoto of MGBR3, Kap. Lowel Sembrano of Brgy. Camachin, Igg. Jun Aquino (CRO) of Ore Asia & other officials to help the affected Barangays.

The said Case No. 03-01371-25-W was already under the management of Department of Environment and Natural Resources-EMB Regional Office No.III (DENR-EMB).

This damage in the river caused by Ore Asia mining was a violation of Republic Act No. 9275, also known as the Clean Water Act, pushing the Environmental Management Bureau to release an Interim Cease and Desist Order.

Furthermore, they have also seen oil in the river that causes fishes and shrimp to die, as well as the check dam was damaged which is used to stop the waste water to come downstream and because of this, lots of silt was seen in river.

They confirmed that the sudden change of color of the Balaong River was due to the waste water coming from the Ore Asia mining, which in the past was known for having a clean water.

The said investigation was held by the Environmental Management Bureau (EMB), Mines and Geosciences Bureau (MGB), Bulacan Environmental and Natural Resources Office (BENRO), San Miguel Municipal Environment and Natural Resources Office (MENRO), & CENRO of Baliuag

The Cease and Desist Order implemented by Environmental Management Bureau (EMB Region 3) was only a temporary suspension against OAMDC to stop the Mud erosion in the river, and to fix the damage waste dam caused by OAMDC.

Meanwhile, Ombudsman Jesus Remulla expect this decision of ICI in charging the involved persons linked to the anomalous flood control projects.

"We expect this kind of action naman. That's the mandate of the ICI."

ICI Chairman Justice Andres Reyes Jr. mentions Sen. Estrada, Sen. Villanueva, and others involved in flood control scandals as he recommends to file criminal and legislative charges against them.
