The questioned funds came from the 2008 PDAF allocation of Villanueva as CIBAC Party-list Representative.

The ₱9.7M was intended for agricultural livelihood projects implemented through the NGO Aaron Foundation Philippines, Inc. (AFPI) and National Agribusiness Corporation (NABCOR).

This damage in the river caused by Ore Asia mining was a violation of Republic Act No. 9275, also known as the Clean Water Act, pushing the Environmental Management Bureau to release an Interim Cease and Desist Order.

Furthermore, they have also seen oil in the river that causes fishes and shrimp to die, as well as the check dam was damaged which is used to stop the waste water to come downstream and because of this, lots of silt was seen in river.

They confirmed that the sudden change of color of the Balaong River was due to the waste water coming from the Ore Asia mining, which in the past was known for having a clean water.

The Cease and Desist Order implemented by Environmental Management Bureau (EMB Region 3) was only a temporary suspension against OAMDC to stop the Mud erosion in the river, and to fix the damage waste dam caused by OAMDC.
