I've seen it in other protest photos; it doubles as a photo backdrop. The top has the Constitution-evoking image, but the tail is just blank parchment-colored material.

Yes, states have ultimate jurisdiction in cases of manslaughter and murder. Because the actions of at least one person led to the death of someone that would fall somewhere within that crime spectrum. Federal charges in these cases focus on the defendant depriving a citizen of civil rights.
