Kelly’s participation in this was wrong. The defense that he was restating the UCMJ ignores the fact that the vast majority of thf people receiving whatever orders they receive do not have the wherewithal to determine if an order is lawful or not.

Kelly’s case is a lot more than meets the eye from a technical standpoint. First off, what he said, literally, is a truism. Servicemembers cannot obey unlawful orders. in ordinary circumstance, the 1A would complete protect hi. But the subtext matters, and there’s an undeniable wink wink quality
