The "Notwithstanding Clause" is a tool that is built into the Canadian Charter of Rights and Freedoms (the Charter). You cannot go against the Charter by using the Charter. Before taking this course, Alberta's government carefully examined every available option. This was not a decision made lightly Binding arbitration would have extended the dispute and delayed the return of students to their classrooms. It would have placed major financial decisions about Alberta's taxpayer dollars in the hands of an unelected third party. Albertans elected this government to make responsible choices - not to delegate them. In practice, an arbitrator would likely have sought a middle ground between the two proposals, leaving taxpayers on the hook for hundreds of millions, potentially billions, in additional costs. And even if binding arbitration had been pursued, there remained a real risk that classrooms could close again once talks shifted to local bargaining. By invoking the notwithstanding clause, we are ensuring that will not happen - that there will be no further labour disruption at any level for the remainder of this agreement. In short, the use of the notwithstanding clause is the only responsible course to guarantee stability, protect students, and prevent further harm to Alberta's kids. Hon. Absolute unadulterated exploitation of innocent animals by unethical human beings. IF the owners had reported the 69 avian flu deaths, as required by law... IF the owners had followed isolation, containment, biohazard protocols as required by law... IF the owners had done everything possible to protect public safety and limit exposure... Maybe they would have a leg to stand on to protect the remaining birds from the cull. But they didn't report the 69 deaths, they hid them. They did nothing to prevent the spread, allowing the birds free and total access to natural water sources and wild ducks and other birds. They have invited and encouraged hundreds people to reely visit, walk all over and then leave a biohazard containment property without enforcing or employing any biohazard containment policies. These hundreds of Ostriches who the family has been exploiting AND slaughtering for decades for monetary gain are suddenly much loved and highly prized pets???? Give me a break. Those birds did deserve the chance to be saved. They deserved for their owners to do everything possible to protect them, by following the rules, ensuring the birds posed no danger, retesting survivors and then negotiating a reasonable and compassionate and enforceable solution. They have lied and cheated and misled and spread misinformation....NO ONE with half a brain now trusts them to do what is necessary, to do what is ethical, legal, to follow any public protection rules.
