I don’t know what to make of this. Does it mean Peters is staying in Colorado? The statement can certainly be read that way! But I don’t know why Polis’ office and DOC absolutely refuse to be clear about the effect of this statement. There are three senior state spokespeople on this statement email!

But it was the feds, not the state, that wanted a transfer. I’ve now asked repeatedly for the state to clarify, definitively, that this statement means that they are not going to transfer Peters out of Colorado. They’ve replied only that “we are not seeking a transfer.”

A spokeswoman for the Corrections Department first said they were still reviewing the letter and nothing had changed. Then she became less certain and said she’d get back with me. About an hour ago, she reiterated that the department “is not seeking a transfer.”

Clerks held their press call today because Polis hadn’t responded to their prior request for a meeting and because they, like others, had “heard smoke” that the governor may sign off on Peters’ transfer. Polis hasn’t detailed his stance on the request, and his office declined to do so again today.

We obtained the Federal Bureau of Prisons request for Peters’ transfer, which says she’s serving time in conditions that “are not conducive to the factors involved in her case.” The state redacted this info when it released the letter to us + other media, saying it was contrary to public interest.

In his order, Judge R. Brooke Jackson called the conditions at Aurora’s detention center “atrocious” when describing one man’s testimony of his detention. Jackson also wrote that a court’s intervention was necessary as ICE seemingly prepares to ramp up its enforcement efforts.

Note that this doesn’t mean ICE can’t arrest people or that it even needs a warrant to do so. But it does require them to follow existing law and to better document how they’re arresting people, with oversight from both the court and the plaintiffs attorneys (which include the ACLU).
