Depuis, il aurait fallu un peu d'honnêteté intellectuelle pour dire à la Chine que sa doctrine d'une seule Chine n'est pas acceptable et ne pas envoyer à l'abattoir certains territoires en leur en donnant le contrôle.

Si on s'en tient à l'histoire et aux principes purement légaux, la Chine est taiwanaise mais le monde a décidé de reconnaître la partie contrôlée par le groupe révolutionnaire communiste devant le fait accompli.
Le gouvernement chinois (donc taiwanais) de l'époque n'était pas génial mais légal.

- ICJ but you need to prove that it is a war crime or a crime against humanity. The first one is valide if you are in a confrontation, the second one if systemic.

I think the consensus is pretty clear outside of the USA. I didn't hear any law expert (outside of the US where some Republicans are trying to justify the crimes) telling that the actions of the US army against civilian boats is legal.
The question is only how to prosecute it.

In international waters, the flag of a ship is giving juridiction.
No need to show a physical flag, we speak about where the boat is registered.
If the boat is asked to identify itself, the captain can tell its flag even if he is not forced to do in international waters.

It is that last point that is making the action of the ICJ so long to come, not that the USA is a member or not, which is totally irrelevant.

The issue is to determine if it was a war crime or a crime against humanity and not a "simple" assassination because the ICJ is not judge common crimes.
It is easier to prove it is a war crime or crime against humanity when it is systematic and/or repeated, or part of a direct confrontation.
