Regardless of whatever arguments they bring to court to justify their actions. The judgement will be made on the grounds of 'good faith'. And... I don't think their actions or statements qualify...

Though, if that were their argument, they should have led with it.

It wasn't their argument, Their argument was that they OWN these accounts. And will do with them what they please, like deleting them for instance.

For the sake of argument, however, X.com could simply claim that based on Alex Jones post history that these accounts infringe on their terms of service. And therefore they have every right to delete them.

It may seem obvious that, Elon, owner and captain of one of the largest social media websites in the world. Is nakedly and nepotistically saving his friend from embarrassment. Yanking accounts from the clutches of The Onion. Don't get me wrong as far as I see that is exactly what is happening.

So we've established that Alex Jones holds copyrights over these accounts. We've also established that these accounts have real world value making them worthy of being called 'Assets' even. Assets perhaps that could be sold, or auctioned off to help repay a whopping $1.5 Billion in debt.

To the eyes of anyone that isn't a moron these accounts hold some real world value. They've certainly been used to post & share various videos and products related to InfoWars and probably made money directly from X.com through ad revenue.

In other words, a sincere action free of malice or desire to defraud others.

Jones automatically has copyrights over these accounts, because he created them and he posted them on x.com.

There's a follower count of roughly 4 million shared between the two accounts.

Well, Section 230 provides a shield from civil litigation to social media platforms for the removal and restriction of THIRD-PARTY content on their website; whether such material is 'constitutionally protected' or not. With the caveat that these actions be performed in "good faith".

How could they possibly moderate their platform? Deleting accounts, and removing content that they deem inappropriate would be impossible as it could easily be seen as infringing on the rights of their users.
