Remember that Jaylon Smith played for Notre Dame. The Jaylon Smith whose serious injury in a meaningless bowl game in his senior season cost him first-round NFL money and nearly his entire career. The reason so many seniors and draft-eligible juniors opt out. ND fans have NOT forgotten.

Nah, ND has played BYU plenty of times, and they have a good relationship. This is about dollars and the artificial SEC/Bama inflation, pure and simple. Penalize every conference runner up except Bama? So ND is letting the $$ talk because they always get good tix sales and TV ratings. ESPN loses $Ms

Why would Currie's statement that the EDVA gets to pick the next USAtty be cause for appeal? It's literally the law, and while not specifically requested, is the only legal path forward.

Quick librarian hot take: it appears that this use might constitute fair use under US copyright law based on the 4-point balancing test, HOWEVER, "fair use" is still infringement. It's just not punishable. TL;DR: it's always best to ask permission.

As a matter of law, this created a demonstrably uneven playing field where a compelling state interest was not, in fact, applied in a truly neutral manner (which is what is required to survive first amendment scrutiny.)

For context, the change in the law applies specifically to what is said in the confessional (outside that, priests do have an obligation to report.) The judge ruled the way he did because it was demonstrably anti-Catholic in that other similarly-situated people with privileged info were exempted /1

I'm curious, can Trump unilaterally fire someone appointed under 28 USC 546(d) and then insert someone of his choosing, or is the appointment immovable until a permanent US Atty is confirmed by the Senate?

Probably unrelated, but the SS would tell their victims they were going for "delousing" ("Entlausung") when they were putting them in the gas chambers.
