Remember that Jaylon Smith played for Notre Dame. The Jaylon Smith whose serious injury in a meaningless bowl game in his senior season cost him first-round NFL money and nearly his entire career. The reason so many seniors and draft-eligible juniors opt out. ND fans have NOT forgotten.

Quick librarian hot take: it appears that this use might constitute fair use under US copyright law based on the 4-point balancing test, HOWEVER, "fair use" is still infringement. It's just not punishable. TL;DR: it's always best to ask permission.

For context, the change in the law applies specifically to what is said in the confessional (outside that, priests do have an obligation to report.) The judge ruled the way he did because it was demonstrably anti-Catholic in that other similarly-situated people with privileged info were exempted /1
