I think we're understanding the question differently but the answer the same way. Your 401(k) is by definition on-shore.

The non-US index funds are likely actually US-domiciled funds that focus their investments on specific foreign markets. They're still being taxed by the IRS. :-(

Yeah but that wasn't the question. Directing those investments to foreign-domiciled issues in order to shield gains from US tax authorities was the premise, and that's not something your average 401(k) haver can do. That takes being a truly wealthy person.
