DHS Terminates Haiti TPS, Encourages Haitians to Obtain Lawful Status Release Date: June 27, 2025 WASHINGTON – Secretary of Homeland Security Kristi Noem today announced the termination of Temporary Protected Status for Haiti. The TPS designation for the country expires on Aug. 3, 2025, and the termination will be effective on Tuesday, September 2, 2025. At least 60 days before a TPS designation expires, the Secretary, after consultation with appropriate U.S. government agencies, is required to review the conditions in a country designated for TPS to determine whether the conditions supporting the designation continue to be met, and if so, how long to extend the designation. “This decision restores integrity in our immigration system and ensures that Temporary Protective Status is actually temporary,” said a DHS spokesperson. “The environmental situation in Haiti has improved enough that it is safe for Haitian citizens to return home. We encourage these individuals to take advantage of the Department’s resources in returning to Haiti, which can be arranged through the CBP Home app. Haitian nationals may pursue lawful status through other immigration benefit requests, if eligible.” After conferring with interagency partners, Secretary Noem determined that conditions in Haiti no longer meet the TPS statutory requirements. The Secretary’s decision was based on a U.S. Citizenship and Immigration Services review of the conditions in Haiti and in consultation with the Department of State. The Secretary determined that, overall, country conditions have improved to the point where Haitians can return home in safety. She further determined that permitting Haitian nationals to remain temporarily in the United States is contrary to the national interest of the United States. Haitian nationals returning home are encouraged to use the U.S. Customs and Border Protection CBP Home app to report their departure from the United States.

ORDER GRANTING PLAINTIFF'S MOTION FOR A TEMPORARY RESTRAINING ORDER For purposes of Federal Rule of Civil Procedure 65(b), the President and Fellows of Harvard College ("Plaintiff") has made a sufficient showing that it has provided notice to Defendants Department of Homeland Security, Kristi Noem, Immigration and Customs Enforcement, Todd Lyons, Department of Justice, Pamela Bondi, Student and Exchange Visitor Program, Jim Hicks, Department of State, and Marco Rubio (collectively, "Defendants") and that, unless its Motion for a Temporary Restraining Order ("TRO"), [ECF No. 56 (the "Motion")], is granted, it will sustain immediate and irreparable injury before there is an opportunity to hear from all parties. Thus, a TRO directed at the June 4, 2025 Presidential Proclamation titled, "Enhancing National Security by Addressing Risks at Harvard University" (the "Presidential Proclamation", as well as the continuation of the earlier issued May 23, 2025 temporary restraining order, [ECF. No. 11], is warranted to preserve the status quo pending a hearing, and the Plaintiff's Motion is GRANTED. P. 65(b)(2), the Court will extend its May 23, 2025 temporary restraining order, [ECF No. 11], against implementation of the Department of Homeland Security's May 22, 2025 revocation of Harvard's authority to sponsor F and J non-immigrant visa holders in a continued effort to maintain the status quo and ensure fairness to all as this case proceeds. This confirm that effective immediately and continuing until new guidance on “social media screening” is issued, no new appointments for F, M, or J visas may be scheduled at consulates without high-level approval.

However, current appointments are not impacted.

Under the TPS statute, if the Secretary does not determine whether a foreign state continues to meet the conditions for designation for TPS at least 60 days before the current expiration of the country’s TPS designation, the period of designation is automatically extended for six months. The Secretary was unable to make an informed determination on South Sudan’s designation by the March 4, 2025 statutory deadline due to the lack of an updated analysis of current country conditions in South Sudan. Accordingly, the TPS designation of South Sudan is automatically extended for six months, from May 4, 2025, through November 3, 2025. This is HUGE. The Trump administration was set to end TPS for 350,000 Venezuelans next month; with another 300,000 or so set to lose their status in the fall (although the decision has yet to be formally made).
