Because true wireless competition has been squeezed out, the FCC must impose strong, enforceable conditions:
• Fair roaming & wholesale access
• Lifeline + affordability commitments
• Prepaid/no-credit options
• Device unlocking
• Open internet / nondiscrimination 6/

The FCC’s shift to prioritizing “spectrum efficiency” forced EchoStar’s hand. The agency’s own investigations created a regulatory environment where EchoStar’s independence became impossible. The FCC created this problem, and now it must mitigate it. 5/

At best, this transfer modestly rebalances spectrum within the oligopoly. But parity among the Big Three dominant companies is not competition. A three-firm market does not self-correct. Without conditions, this deal simply entrenches a structure that harms consumers. 4/

The Justice Department recently warned that AT&T, Verizon, and T-Mobile already operate as an “oligopoly,” controlling 90%+ of subscribers and 80%+ of mobile-use spectrum. This transfer deal deepens that problem. Doing nothing is not an option. 3/

We’re not happy about this transaction. Once the Commission made true competitive entry for wireless services impossible, Echostar's spectrum was inevitably going to be allocated to one of the Big Three. But that doesn’t mean the FCC can wave this transfer through without safeguards. 2/
