Advice of counsel can provide a defense in some cases. But, counsel’s advice has to be based on knowledge of all relevant facts. Here they have an opinion from DOJ, not senior military counsel, that is based on “facts” given to them by the Trump Whitehouse. Those statements of fact were lies.

Gnarly separation of powers issues here. Can’t be active duty military and Senator at same time. Sexpest can’t simply yank Kelly out of the Senate in the middle of his term unless the Executive branch is the boss of the legislative branch.
