The thing is, Perry didn't do anything wrong. The nuns tried to sell property that didn't belong to them while the legal owner (the Diocese of LA) was negotiating the sale to Perry. Worse yet, the nuns would have gotten ripped off had their sale been perfected.

You should explain this to Koreans, too. I can't tell you how many of them I used to hear talking (improperly) about "Bukhan" or "Ibuk" instead of using the formal name of the country to the north.

I'll offer the unpopular theory that there was *something* sufficient to give defendant notice that the Government intended to charge him. I realize I'm conflating language from case law for superseding indictment with new, etc.

I have a vague recollection that the applicable statute allows filing of a new indictment so long as the dismissal occurred after the statutory period and for any reason other than it being untimely.

Exactly. That's why we have such strict gun control laws: because even Republicans support gun control. 70% of Republicans support barring gun sales to anyone under 21, which is why it is illegal right now. That's just science.
