These docs should be viewed alongside parliament's debates on the EA and GRA, other contemporary docs, and multiple decisions of the UK and EU courts from the past 20+ years. Taken together, there's a clear consensus over decades that trans inclusion is the correct policy, which was ignored by SCUK.

That "settlement" was *explicitly amended* by the GRA. Reed et al apparently think that Parliament intended a trans woman with a GRC to be treated as a woman for the purposes of employment in a job which involved intimate contact with other women, but an equal pay claim was a bridge too far. Inane.

Four of the five judges from the FWS case criticise Scotland's protections for rape victims by referencing the Human Rights Act and the ECHR, two things they had to actively ignore to misinterpret the equality act. Human rights: good for literal rapists, but not for trans people, apparently.

...isn't this the exact opposite of the argument he was just making? Different facilities are segregation, different treatment, and an automatic disadvantage, but also *not* different treatment, but simply mirrored treatment, whichever happens to suit his needs at the time?

I'm not convinced even that creates any real problems. The Interpretation Act 1978 says that "unless the contrary intention appears...words importing the feminine gender include the masculine". I'm sure SCUK would argue that the contrary intention does appear, but that's just circular logic.

The government's explanatory notes explicitly state the purpose of the EA as giving effect to several EU directives. That includes the Equal Treatment directive, which both EU and UK courts have found requires sex discrimination law to be understood as trans inclusive.

Why did you think it was appropriate to talk about a trans child having no experience of life as a cis adult? Would you apply the same standard to a gay child? Do you recognise that "how do you know you're gay if you haven't tried being straight" is homophobic? Why would you apply that logic to us?
