ScotGov is only now producing (non-stat) guidance. And has been "exploring options for strengthening the legal framework" since at least 2022, without much sign of progress.

Last year we & others called for a coherent stat framework on restraint & seclusion in all settings.

A letter from the Children and Young People's Commissioner Scotland, the Scottish Human Rights Commission, the Equality and Human Rights Commission, the Mental Welfare Commission, and the Promise Scotland. The letter calls on the Scottish Government to put in place a legislative framework on restraint and seclusion across all settings where children are in the care of the State.
