Daniel Penny’s acquittal isn’t surprising. It was a tough case from the jump, and I said the District Attorney’s Office should have pleaded it out even if it meant little or no time. 🧵

A mistrial on the top count of manslaughter is both a win and a loss for Penny and the defense. It’s obviously a win because Penny is no longer facing a 15 year prison sentence on the top count, and negligent homicide only carries a 4 year maximum sentence. 🧵

As bad as Matt Gaetz was, and I think he’s one of the worst Cabinet appointments in American history, Trump’s nominee for the #2 position at the DOJ, Todd Blanche, is actually qualified. Maybe Trump will nominate him for AG.

It was inevitable. Jose Ibarra was found guilty of killing Laken Riley. The Venezuelan gang member was an undocumented immigrant, and that got all the headlines. Still, there was an avalanche of video, digital (cell phone), and forensic (finger and DNA) evidence for the prosecution.

Fascinating and novel issues flowing out of the Trump conviction in New York. A conviction did issue, but it doesn’t look like sentencing is going to happen anytime soon.

Donald Trump may not be a felon after all...

Judge Juan Merchan continued next week‘s sentencing (again) without explanation. That leads me to believe that he is considering dismissing the case entirely. Otherwise, why not sentence Trump to a fine and get it out of the way before he takes office?
