In this proceeding, the Court is now being asked to determine whether the Initiative Petition Proposal complies with section 2(4) of the CIA, which provides that a referendum proposal "must not contravene sections 1 to 35.1 of the Constitution Act, 1982" The Treaty 8 First Nations of Alberta have intervened in this proceeding to ensure that the constitutionally protected Treaty rights of it's member First Nations are fully respected, honored, and upheld.
