but to your broader point, i'm not sure where authority comes from allowing fed gov to step in and interfere with how states set tuition rates. i just know this has long been the policy landscape

Many state have these workarounds to allow undocumented students get in-state rate even though fed law prohibits doing it directly. So states make a rule like even if you're not an in-state resident, you get the in-state rate if you completed grades 10-12 in-state www.nilc.org/resources/ba...
