Sandwich Guy thanks everyone for their support, “emotional, spiritual, artistic or financial.” Intones, “Let us not forget that the great seal of the United States says…‘ out of many, one.’…You all have a right to live a life that is free.”

“SO HAPPY!” the defense attorney exclaims upon exiting the courtroom. “I hope you are happy too,” she says to the media liaison for the court, who replies, “Well, I’m the media liaison for the court.”

Neither government nor defense requests anything at this time…not even an afternoon snack. So that—and I know you’ve been waiting for it—is a wrap.

A source familiar has informed a reporter here that sandwiches from the cafeteria were involved.

One might argue that refreshments and lunch, while seemingly different terms, are actually synonymous and therefore interchangeable.

Another definitional dispute we in the press room have discovered: whether jurors could be provided lunch during the shutdown—some prohibition against “refreshments.” Docket indicates meals ultimately were paid for by clerk of the court. We don’t know whether sandwiches were involved.

The defense believes this requires a mistrial, because in its closing it was operating under the belief the terms had different meanings. The judge says he’s happy to have briefing on that topic “after we get a verdict.”

Judge will tell the jury, “The phrase ‘bodily harm’ as used in this sentence…carries the same meaning as injury in the next sentence.” The sentence at issue is the one defining “assault.”

Judge is deciding whether to define bodily harm and injury as interchangeable — which the government wants, and the defense decidedly does *not*.

Who knew it would be this complicated?! Not the judge. Not me!

The government takes some time to think about the definition. The defense says this is simple: Bodily harm means harm to the body. Government comes back and says basically that bodily harm can include injury— and “offensive touching” is sufficient for that.

The note is a question: “Please define ‘bodily harm’…How is ‘injury’ different from bodily harm?”

No verdict today. Back tomorrow. For now, a reminder that you can spend your money on a Subway footlong at 11 p.m. on a Sunday. Or you can donate to support Lawfare’s non-profit work here (or both, I guess!): givebutter.com/journalism/m...

The jury is entering deliberations now. If they come to a verdict today, cool! If not, they’ll be dismissed at 5 and we will return tomorrow for Day 4 of not the simplest case in the history of the world.
