NEWS: During a hearing in federal court in VA, prosecutors confirmed that the operative indictment in the case against James Comey was never shown to or voted on by the entire grand jury before it was presented in open court.

Defense counsel argued that’s a complete bar to further prosecution

If the DoJ opens (or reopens) investigations that involve prominent figures in the Epstein files, can the DoJ then refuse to release the files as they are, once again, evidence in an open federal investigation?

Everyone’s like “so what do these pardons DO??” and honestly I’d say it probably has more to do with this than anything substantive, at least for now

It’s a communicative pardon
Notably, this pardon comes just days ahead of a Nov. 14 deadline for the Prosecuting Attorneys’ Council of Georgia to appoint a replacement prosecutor for Fani Willis, who was disqualified from pursuing the case.
Trump’s pardon attorney Ed Martin claims Trump is pardoning his Georgia co-defendants and other “alternate electors.”

Note: Trump’s Georgia co-defendants are charged under state law. The president can’t pardon people for state crimes.

The stopgap spending measure needs to be approved by the House. While this appears to be a fait accompli it remains to be seen if Johnson will call the HoR back into session before 17 NOV and if this CR will face speed bumps getting through the HoR.

Assume all the yes and no votes from Dem senators are strategic and not sincere votes. The party caucus made a decision. No way to know how many were in favor. Then the caucus decided who would vote yes and no based on what would protect each of them politically the most. That’s how this works.

-if she denied the admin stay, the full SCOTUS woulda stepped in to override her.
-if she immediately referred the case to the full Court, they coulda dragged feet.
-instead she boxed them in to act quickly once she does refer the case.

The stay to stop the disbursement of SNAP benefits is a short term Pyrrhic victory on the longer road to national self-immolation.

Suspending judgement on SCOTUS/Jackson as this may prevent a longer delay.

I think what is happening here is that Jackson is doing the 48hr pausing so the First Circuit (hopefully) declines to place a stay pending appeal (which would be a longer stay) and then the Court will be in the tougher position of delaying SNAP for a longer stay period.
#BREAKING: Justice Jackson has issued an "administrative" stay, temporarily pausing a district court order that would've required the USDA to continue using contingency funds to pay SNAP benefits.

The stay expires 48 hours after the First Circuit rules on USDA's request for a stay pending appeal.
