Examples of inappropriate behaviours towards trans people include, but are not limited to, the following: • Making jokes about trans people or their trans identity; • Ostracising a trans person; • The denial/refusal to address someone by their affirmed identity in their interactions with and about said person; • Consistently using incorrect titles, pronouns, or names to refer to a trans person— especially where this may cause distress and the affirmed terms of address are known; • Personal questioning (or any similar conduct) which is unwanted, especially when this either: o Has the purpose or the effect of violating the other person’s dignity; or o Continues after the explicit expression that the questioning stops; • Inciting hatred or violence against trans people; • Cyber bullying; and • Physical violence of any kind. All incidents will be investigated and reviewed on a case-by-case basis. Consequences for such harassment, victimisation, discrimination or creating unsafe environments may include, but are not limited to, a suspension from membership and funding by the LMS. The LMS invites any trans person experiencing such negative behaviour in any aspect of the Society’s work to email the Society directly at governance@lms.ac.uk.

Why have you included a statement that is not true? The Supreme Court did no such thing.
While this was unsuccessful, the Kenwood Ladies’ Pond Association (KLPA) rejecting a motion among its 200 members last year that “only those born female in sex can use the pond”, pressure has since mounted after the supreme court ruled earlier this year that trans women were not legally defined as women.

Indeed, in the statistics, the study includes people who were recorded as having a gender identity different to their 'interviewer assigned sex' as their self-identified gender.

So the 66% number includes all the people recorded as 'trans' by interviewers.

This stuff is easy to find., Times.
Given (i) the large overlap between the new self-reported gender question on the survey and interviewer-coded sex, (ii) that our measure of the importance of gender identity relies on the self-reported measure, and (iii) that interviewer-coded sex is not necessarily a more reliable measure than that which the respondent reports, we will rely on self-described identification as a man or woman throughout this analysis.

I am struck once more by the ridiculousness of this paragraph used an example.

Neither cervical nor prostrate screenings rely on being single sex services for their provision and it is frankly idiotic to suggest they are. They are provided for people with a cervix or a prostate.

They are such a bunch of hypocritical morons.
The only objective category which Parliament has established in relation to transgender identity is that of “acquired gender under the Gender Recognition Act”. Parliament has also established stringent rules (s.22 of the Gender Recognition Act) concerning disclosure of the fact that someone has a gender-recognition certificate (GRC). This information therefore should not, indeed cannot, be routinely collected.

Someone on Reddit sums it up aptly.
Basically the only way to fix this without breaking the ECHR, HRA, GRA, GDPR etc is to legislate to undo the SC ruling or use section 23 of the GRA to fix this instantly with a statutory instrument (assuming I’m right about what s23 does). We know it. The government knows it. The EHRC knows it. But for some reason they’re rushing headlong into making us the first western nation in history to implement a nationwide bathroom ban. We will literally become the worst western nation on the planet for trans rights. How is your “safe pair of hands” looking now, Starmer?

This is what I hashed out in a rather irate half an hour before electrolysis today. It can (and should) definitely be added to.
Response to Q3: This is ill-thought out and poorly judged. The Supreme Court judgment in FWS v Scottish Ministers explicitly states in paragraph 2 that the judgment solely applied to the Equality Act 2010 and not to other legislation. Indeed, the judges cautioned against doing so. The Gender Recognition Act 2004 (GRA) explicitly states that a person with a Gender Recognition Certificate (GRC) is legally recognized as their acquired/lived sex "for all purposes". Why does the Scottish Government believe it has the right or power to over-rule this primary national legislation in a bill on crime? The justification given appears to solely be based on there being "no overlap" between "sex" and "transgender identity". This is ridiculous. The characteristics in the 2021 Bill all overlap and people share multiple characteristics. A person can be gay and a person of colour, for example. Moreover, a hate crime can be motivated by one or more of the characteristics. A transgender person being targeted on the basis of their sex should be covered in the same way as a cisgender person of the same sex. Bluntly: using the commonly understood legal definition of sex as covered by the GRA does not, in any way, lessen the protections for cisgender women and girls in this legislation, so it should be used as to not harm transgender individuals of the same sex. Response to Question 4: This appears to be a breach of GDPR rules, which must record data based on someone's lived sex as described by them, not by their sex assigned at birth (see recent rulings at eg the CJEU C-247/23 | [Deldits], 2025). This tallies with the incoherence mentioned in the previous response. The UK, and thus Scotland, is required by international law to recognize the lived sex of a transgender person. This draft breaches that law. Response to Question 5: This draft appears to be written in contravention of the GRA and standing GDPR regulations, and thus breaches international law. Indeed, the GRA exists explicitly to address historical UK human rights breaches that do not recognize transgender individuals in their lived sex (Goodwin v UK 2002, I v UK 2002). This drafting explicitly breaches that. Scottish law must treat transgender individuals in their lived sex for the purposes of crime legislation. This does not do this. Response to Question 6: As stated above, this trans-exclusive drafting has a significant negative impact on people with the characteristic of 'gender reassignment'. Their protections and rights under the GRA based on international human rights law are, for no tangible benefit or justification, being disapplied by the Scottish Government. Sex must be treated as lived sex, not a piece of paper from years in the past. All women and girls are targeted in the same way. Stop this damaging and toxic culture war.
