There is also the legal principle of restitution outlined in Kingstreet investments against an unlawfully collective tax. If bill C-4 becomes law, then there would be no legal authority for CRA to limit the rebate to the prior narrow scope.

Lowering a tax does not infringe on the financial intiative of the Crown. Even if the tax is already collected and held within the Consolidated Revenue Fund, an individual would still be entitled to be rembursed. Officials confused this in committee.

LG Wilmot then invited Andrew Blair to form a new government.

Note that at this time a request for dissolution appears to be a Cabinet decision rather than solely the right of a Premier to ask the LG.

The responding letter says "His honour is unable to concur in the views entertained by council respecting dissolution. The LG without delay will be seeking other advisors"

This challenges the narrative of an orderly transition of government & is similar to the BC LG refusing Clark's request in 2017
