I take a few shots at Grey v IRC, and the idea a trust can exist without being enforceable, rounding off by agreeing with the CoA maj that this is essentially about sham (transaction at an undervalue under the IA 1986) bearing on constitution of the trust, rather than really being about formalities.

I argue based on the archival materials relating to 1925 that the drafting intention was not to break with the Statute of Frauds, but also that the drafters’ understanding of agency - which bears on this case - was a bit different to what has been thought so far.

I got into the just sum in BP v Hunt and we agreed that they would keep an admin fee not the whole deposit, as they initially tried to. Their manager seemed a bit shell shocked by the end of the conversation. Good teaching material ever since, though.

Did the policy pay out? Ours didn’t cover infectious disease outbreaks and I ended up giving the venue a lesson on frustration in contract law to get our deposit back.

It’s a bit of a strange scenario in that our wedding was originally planned for 2020. I picked up my wedding dress 3 days before the first lockdown. And then we moved to Scotland, so I was less bothered (no CICT in Scotland!). And now we’re back down, so… 😁
