That's why it was modernized and codified as an international war crime and crime against humanity by the Geneva Conventions at the close of WW II.
It applies not just to declared war but to "any other armed conflict."

GENERAL PROVISIONS
Article 2
In addition to the provisions which shall be implemented in peacetime, the present Convention shall apply to all cases of declared war or of any other armed conflict which may arise between two or more of the High Contracting Parties, even if the state of war is not recognized by one of them.
The Convention shall also apply to all cases of partial or total occupation of the territory of a High Contracting Party, even if the said occupation meets with no armed resistance.

Article 3
In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties, each Party to the conflict shall be bound to apply, as a minimum, the following provisions:

Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, colour, religion or faith, sex, birth or wealth, or any other similar criteria.
To this end, the following acts are and shall remain prohibited at any time and in any place whatsoever with respect to the above-mentioned persons:

(a) Violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;
(b) Taking of hostages;
(c) Outrages upon personal dignity, in particular humiliating and degrading treatment;

(d) The passing of sentences and the carrying out of executions without previous judgment pronounced by a regularly constituted court, affording all the judicial guarantees which are recognized as indispensable by civilized peoples.
2. The wounded and sick shall be collected and cared for.

As an insurance defense lawyer she'd know how to do a Westlaw/Nexis/Lexis lookup or just Google "Steps for a federal felony indictment."
I've practiced mostly civil law for 45 years & easily found FRCrP 6 & 7; Grand Jury form AO190
Did she take & pass L1 research & writing?
Is that still taught?

It's common in many jurisdictions to draft the acceptable counts into an indictment for the GJ's final vote.
So far there's no record of the redrafted indictment's final vote
We'll see if the jury foreman ever filled out this form* and gave it to the court clerk

While we approach the celebration of the nation's 250th anniversary, it may be wise to remember that a major spark in the Revolution was George III's proclamation from the summer 1775 that started the process of the English Army occupying the colonies.
It's the origin of the 3rd amendment.

Also FRCrimProc states:

(c) Foreperson and Deputy Foreperson. The court will appoint one juror as the foreperson and another as the deputy foreperson. In the foreperson's absence, the deputy foreperson will act as the foreperson. The foreperson may administer oaths and affirmations and will sign all indictments. The foreperson—or another juror designated by the foreperson—will record the number of jurors concurring in every indictment and will file the record with the clerk, but the record may not be made public unless the court so orders.
