Both the 2019 and 2022 rules, by providing a finite list of factors for inadmissibility, contradict the "inherently discretionary nature" of public charge determinations, DHS says.

Bottom line: the agency says officers should have broad leeway to find applicants will depend on public benefits.

Notably, DHS says both the 2022 Biden public charge rule and the 2019 public charge rule under the first Trump admin were too narrow.

Both rules "severely and unduly limited the factors that DHS could consider in making a public charge inadmissibility determination."

DHS spox Tricia McLaughlin called the order “nothing short of open defiance against the U.S. Supreme Court.”

But the panel addressed government arguments about the justices’ May order voiding preliminary relief.
