The Appeals Court comes to this conclusion by stating that domestic Swedish law & its understanding of genocide can have wider scope than the one adopted by international courts. Swedish law has wider scope based on will of the legislator (i.e. the parliament) as evidenced in the preparatory works.

The Appeal Court's reasoning very interesting on page 7. The perpetrator has to have intent of destroying a protected group in physical sense, but the actual acts does not have to include acts that involve physical destruction. The acts can include destruction of religious & cultural expressions.
