FWIW, Ferguson says he pulled the FTC's inquiries into pricing because of timing/process objections, not necessarily substance.

However, absent any replacement initiative, this sends a message to the marketplace that pricing is less of a priority for the agency now. www.ftc.gov/system/files...

Of course, the key question is what qualifies as consent. The FTC's complaint against Gravy says a consumer granting an app access to location is NOT consent for a downstream data broker to sell it. The consent needs to be specific for the purpose. www.ftc.gov/system/files...

A lot of the complaint is blocked out, but this is an interesting example. The combination of unequal presentation of choices, difficulty in bypassing, and close proximity of "close" to the "sign up" button = deceptive dark pattern.
