You're giving courts way too much credit that they understand technology and how that's different than someone asking giphy based on a text prompt to give them a gif of Batman.

How do the gif hosts make money and would anyone use them if 99% of the content there was not based on copyrighted material?

To be clear, I'm not defending the AI companies. I'm just saying there's a lot of nuance here and an overly broad decision in this case could be used to attack fair use

I mean... every reaction gif host has copyrighted works on their servers. Then they allow people to use that copyrighted work to put text overtop. Then they host and redistribute it.

People need to be careful about what they're celebrating here and decisions in cases like these set precedent
