Some people are questioning whether this is AI. One way to be certain is to geolocate the video, as AI still struggles to accurately recreate really world locations with enough fidelity to be successfully geolocated. The first question is what's the best information about where this was filmed?

NYT video review confirms this. Pretti had a 2nd Am right to carry a firearm. But even if he didn’t he wasn’t pointing it at anyone or threatening agents. There is no legal justification for the execution-style shooting & no basis for DHS’s claim he was there to massacre them. He was a helper.
Brandishing is a legal term that means to display all or part of a firearm, or otherwise make its presence known to another person to intimidate them, regardless of whether it's directly visible to that person. Given the video, that's not what Alex Pretti was doing when he was shot & killed.
