I’ve heard the same and I don’t see how a) paygo is avoided and b) that wasn’t part of the plan all along - except it will be interesting to see how they exempt the military from the mandatory cuts 🤷‍♂️

Yep. For those who don’t already know, roughly 90% of seniors this bill was designed to protect from being taxed on their Social Security already paid little to no federal tax on those benefits before its enactment. (“Fast Facts & Figures About Social Security, 2023” -SSA)

The part that should be focused on the most is when they say this is based on the “Judicial Prerogative of the King” originalism with regard to the High Court of the Chancery. #NoKings

Further, there needs to be a large fund afforded to class participants so that everyone can afford a defense. It’s a huge waste of money, but it has to be done.

I would add that for the most part, Trump has had a terrible record in appeals courts. He loses about 70% to 80% of the time, and when he does win that appellate court is reversed by SCOTUS 90% of the time.

This is what I’ve been saying, but establishing standing will be difficult, and in the future Dems will need to have multiple cases, basically crafted with a justification goal in mind, and often playing the long game, to succeed as the GOP has. It’s a different game afoot.

Dems, for the most part, get behind cases as they come, the GOP crafts their cases, even toward a desired goal (often multiple cases). Once again, Dems need to change how they play the game to be proactive. The first biggest issue is establishing standing in ways they have not tried previously.
