Under the "unitary executive theory," any congressional limits on the president's control of the federal government are unconstitutional. But the Supreme Court siding with the Trump administration on these grounds could have serious consequences for our democracy.

At this point, the shut down has gone on so long that in at least one proceeding I'm following (PS 21-346) comments and reply comments are due the same day.

I hope the FCC issues guidance on this. Replying to things we haven't read will be difficult. /2

I'm also going to applaud FCC Chairman Carr for (a) finally seeking comment on this issue every Chair since Michael Powell has refused to touch; and, (b) framing the classification question neutrally.

Regulating interconnection is essential to the smooth operation of the phone network, and a core responsibility of the FCC. But as the FCC has refused to classify VOIP as Title II service, its unclear whether the agency would be able to continue this role after the transition.

I have been told that manufacturers generally try to get their Xmas stuff certified by July. But I have no idea how that has worked out.

A few other things may also impact the processing wait. The FCC avoided mass layoffs, but largely because a lot of their senior staff retired. So they are (even more than usual) short on engineers. Plus Carr decertified some Chinese testing labs.

During a shut down, the FCC can't process the necessary applications. When I wrote this in 2013, that was 1,000/month. I have no idea what it is now, but I doubt it's gone down. These things are processed in the order they arrive. So the longer the shut down the more backup.
