The dissent notes that the majority did not name Purcell. The dissent notes the ability of bad actors to use Purcell to justify their desired outcome. Also notes how Purcell should not apply here and the lower court had addressed it in their ruling.

The 3 judge panel determined that this Texas gerrymander was based on race (even though partisan benefits were desired).

SCOTUS 6 says * without factual basis * that it was a partisan gerrymander but the 3 judge panel wrote extensively and conclusively that the facts made it an unconstitutional racial redistricting.

Was this a randomly assigned panel? Katsas and Rao seem to be drawing a lot of cases where they can support Trump by overturning the district court’s ruling.

It will, however, be implemented for 2 years while the question of constitutionality works its way through the legal system. This time frame is fixed regardless of the proportion of cases which find it unconstitutional (97 to 3). It will eventually make it to SCOTUS merits hearing.

The plaintiffs got a bad appellate panel of Reagan, Trump, Trump judges who initially took a pro ICE/CPB position that would have overturned Ellis’ ruling. If the plaintiffs withdraw the case with prejudice the appeals court won’t issue a (precedent setting) final pro-CPB ruling in the case.

The obnoxious alarms were imposed by governmental legislation because the seatbelt uptake was opposed by so many libertarian (idiots).
Eventually the carmakers realized that the mandate was here to stay and improved seatbelts and made them more comfortable.
