El Hishri is suspected of committing or overseeing crimes against humanity and war crimes between 2015 and early 2020, including murder, torture, cruel treatment, rape and other forms of sexual violence, persecution, and outrages upon personal dignity, at Tripoli’s Mitiga Prison.

El Hishri was arrested in Berlin in July. He appeared before the ICC for the first time on 3 Dec, with the confirmation of charges scheduled in May 2026. This marks the first time a Libyan suspect is brought before the ICC since the Libya investigation was opened in 2011.

Speaking at the event FIDH President Alexis Deswaef
said: “we are not facing a legal vacuum or ambiguity in the Statute as some states argue. Rather, we are facing a crisis of political will.”

It calls on States Parties to fulfill their arrest & surrender obligations to uphold the principle of equality before the law and maintain the credibility and effectiveness of international criminal justice.

16 years after the 28 September massacre, victims deserve truth, justice & full reparation, not setbacks. IOM report must lead to concrete action. Justice cannot stop halfway.
