43m ago13.14 AEDT Graeme Samuel welcomes EPBC deal The man who five years ago wrote a report with recommendations that will finally be implemented today, says he’ll be “delighted” to no longer hear his name mentioned in the media five times a week. Graeme Samuel popped up on Sky News said all the reforms are “sensible” and “tighten up issues that will both be in favour of protecting the environment” while not impacting efficiency. I went through the amendments this morning with the minister’s office and gave a tick across every single one of them … The problem is that we keep kicking the can down the road. The can just gets dented and gets rusty and and I think there was no guarantee that would ever get there. Now, what Minister, what has done, in great credit to him, he said, ‘This is it. We’ve got to do this now' and let’s get the thing moved’. He said it will now be up to the parliament and the environment department to set all the new rules and environmental standards that will be established under this legislation.

‘Missed opportunity’ is also the reaction of the Business Council of Australia who say the reforms won’t deliver “transformational economic change”. BCA chief executive, Bran Black, says the business group has supported reform to the environment protection and biodiversity conservation act (EPBC), but raised concern that the agreed upon position still contains “ambiguity and risk, which may shut out projects before a proper assessment”. In a statement, Black says: We have always said a sensible, stable reform backed by both major parties is what we need if Australia is to deliver the energy and renewables, critical minerals and infrastructure projects that underpin productivity and living standards. Our concern with this package, as it stands, is that there’s lots more work to do to deliver a net benefit for business and the economy. He also adds that the BCA does not support the concession to the Greens that prevents gas projects from being approved through “streamlined pathways”.

But they warn the job of protecting nature isn’t done, and express concern that the legislation will still allow the expansion of fossil fuel projects. The Greenpeace Australia Pacific CEO, David Ritter, said: The agreement announced today secures a significant improvement on the broken laws that for too long failed to deliver credible environmental protection. Removing the risk of fast-tracking coal and gas projects is also welcome. But the big sting in the tail is that the legislation still fails to address the enormous climate harm to nature from these sorts of projects. It still leaves the door open for the heedless expansion of coal and gas. The Climate Council CEO, Amanda McKenzie, said the law still “fails” the 2025 climate test. This deal strengthens protections for our native forests, and provides a faster yes to responsible renewable energy projects that cut climate pollution … But this 2025 law fails the climate test. All new coal and gas projects still get a free pass on climate pollution. In fact, the law forbids the environment minister from considering a project’s climate pollution when assessing whether it should go ahead.

1h ago09.34 AEDT ‘Dodgy dirty deal’: Coalition furious over EPBC agreement Jonathon Duniam, who was a key negotiating figure for the Coalition is ropable in the Senate – which has passed the motion to bring on debate of the environment bills. He says the bills will “now be rammed through in record time” and warns the bill will see native forestry “shut down” within years. The government was negotiating with both the Coalition and the Greens to pass the bill, with two separate sets of amendments. Duniam is not happy the Greens won out on the negotiations, and says the Coalition found out that the government was not accepting its amendments at the prime minister’s press conference this morning. This is a pattern of behaviour at the end of every sitting year we see the arrangement be the mighty new Labor-Green alliance come together, they’ve been together behind closed doors for a couple of weeks now hatching this one up. Where are they [Labor] standing up for the workers who have been abandoned under this the dodgy, dirty deal done behind closed doors at the 11th hour. He’s also critical of the Greens who had forced the parliament to set up an inquiry into the bill, that’s due to report back in March next year. Who’s voting to ram the bills through the Senate today, none other than the Australian greens enviro spokesperson senator Hanson-Young and all her colleagues.

Santos says it is time for people to move on and back Narrabri gas project Santos has responded to today’s statements by the NSW Farmers’ Federation about exploring avenues for legal action against the company’s Narrabri gas project due to concerns about impacts on groundwater. The company says it is time for everyone to move on. A Santos spokesperson said: In 2020, the NSW Department of Planning found in its assessment report, that it is “ difficult to reconcile the significant community concerns about the Narrabri Gas Project with the technical advice from experts that the risk of any significant impacts occurring is generally low and can be controlled using standard engineering practice and imposing strict conditions on Santos. The spokesperson said the project had been approved by the state’s independent planning commission after consideration of the state planning department’s assessment report and other expert evidence on groundwater. They said a legal challenge to the approval was dismissed by the Land and Environment Court in 2021: It’s time for everyone to now move on and respect the outcome of the extensive approvals and litigation processes that have been carried out for the Narrabri Gas Project under NSW and federal laws, including recognising that the project is in the public interest and is necessary to ensure energy security and reliability for east coast gas and electricity consumers.

The assistant minister for immigration, Julian Hill, has hit out at the Coalition and One Nation for stoking an increasingly “toxic debate” on immigration in Australia. Speaking at a conference at the Australian National University in Canberra on Tuesday, Hill said the parties are seeking to “generate anger, trade on the ancient human instinct to fear people who are different, or to foster division for some belief in short-term partisan gain.” But he warned the Coalition of forgetting the lessons of One Nation’s rise in the late 1990s, when leader Pauline Hanson first rose to prominence for attacks on Asian immigration. She was suspended from the Senate on Monday after a stunt in which she donned a burqa in the chamber and disrupted the sitting. Hanson has a bill to ban face coverings before parliament now. Hill said former prime minister John Howard understood how to deal with Hanson. “As Penny Wong said last week, you can’t out-Pauline, Pauline,” he told the conference. The Labor party knows this with respect to the Greens political party – you can’t out green the Greens, and do not ever try. They are populists and not actors of good faith. Their political business model is as a party of protest not a party of progress – similar in that sense, actually, to One Nation. To try to accommodate them is to legitimise them. Independent MPs are pushing for changes to Labor’s proposed new nature laws, with one claiming the bill contains “gigantic loopholes that you could drive a heavy hauler through”. The laws to overhaul the Environment Protection and Biodiversity Conservation (EPBC) Act are scheduled for debate on Tuesday, with the government planning to rush them through the lower house this week. The independent MP for Curtin, Kate Chaney, is drafting amendments to address two loopholes that she fears could undermine the entire bill. The first is the proposed “restoration fund”, which developers would have the choice of contributing to as one option to offset damage from their projects. Chaney said: That means projects can actually just pay to destroy, they can choose to just put money into a fund, and we may end up with a lot of money but no projects that actually offset the damage that’s being done. And that would not be a good outcome for nature. The independent MP also wants changes to a contentious new exemption that would allow the environment minister to approve projects in breach of nature laws if it was deemed in the “national interest”. The former treasury secretary Ken Henry, the Labor MP Ed Husic and Labor’s grassroots environment action group have all called for guardrails to limit how the power could be wielded. Fellow independent MP Sophie Scamps said she couldn’t support the laws in their current form, criticising the new loopholes and plans to devolve more decision-powers to the states. I cannot support the EPBC Act … in their current form, because there are the most ginormous, gigantic loopholes that you could drive a heavy hauler through, which means there is no guarantee that our environment will be better protected. Labor wants the EPBC reforms to pass the Senate this year but that hinges on a deal with either the Greens or the Coalition, neither of whom support the bill as it stands.

And when the wind isn’t blowing and the sun isn’t shining, we need to be able to turn on other sources of energy to keep industry going. NSW premier floats compulsory land acquisitions and says he will do ‘whatever it takes’ to make controversial Santos gas pipeline happen Farmers whose land will be traversed by a proposed pipeline carrying gas from Santos’s controversial Narrabri gas field face compulsory acquisition of the corridor by the NSW government. More than 100 impacted properties owners in the Hunter Valley alone are opposed to its construction. About 66% of landholders along the entire HGP route have so far not agreed to host the pipeline on their land. But the NSW premier, Chris Minns, said he would do whatever it takes to make the project happen and that he considered more gas essential for NSW industry. He told the Australian Workers Union Conference on Wednesday: Since coming into office, we’ve made every approval that’s been in front of us in relation to the Narrabri project. I can tell you today that we want landholders to work with Santos and the owners of the fields to come to an agreement that works for both parties. But if that doesn’t happen, we will be considering compulsory acquisition of the pipeline easement around the field to ensure that the project gets going and that we can get energy into the manufacturing base of the Hunter for New South Wales. The premier urged Santos to give final investment signoff to the controversial Narrabri project while also urging the commonwealth to establish an east coast gas reserve: What we need now is for Santos to, quite simply, commit to Narrabri and make an investment decision. And we need the commonwealth government to finally pull the eastern states together to establish the east coast gas reserve so Australian gas is used to support Australian industry, first at Australian prices. The gas reserve is well overdue. It’s a no brainer. It needs to happen.
