The law was meant to regulate the testing of vehicles that would eventually self-drive, and Uber knew that. It exempted ADAS vehicles. Both Uber ATG's vehicles and Tesla's robotaxis (and indeed their "full self driving beta") vehicles are intended to eventually self-drive.

Didn't catch that, so did they in fact take passengers or just act as though they might? However, not sure it matters a lot. Tesla is certainly taking passengers in their test cars, testing a system named robotaxi, clearly a self-driving prototype.
