This seems to be a battle they have been fighting for years at this point so I am not as worried about them bucking any further.

The Better Business Bureau is a private organization that only really has the power to send a strongly worded letter, and they don't have the power to do anything if they are just ignored. Still might be worth it to complain there but I would not put much stake in them being effective.
