I think the nuance in this is what should be the focus of campaigning vs. ALL of the things you will fight for. No one is suggesting anyone should be dishonest in supporting LGBTQ+ rights (if someone asks, you tell them your personal beliefs), but if the goal is to win, focus on the broadest mssg

While it may do nothing as far as petitioners rights to bring habeas claims, wouldn’t it hamstring courts on ruling that the invocation of the act was illegal?

I think it is important to point out that the phrase “you can indict a ham sandwich” stems from the fact that the DOJ historically doesn’t try to indict someone unless they think they can prove their case beyond a reasonable doubt. It will add fodder to selective and vindictive prosecution motions
