State fuel taxes were overturned in 1997 in the wake of Ha’s case, a decision on tobacco license fees. This case confirmed that excise could be levied on sale, production and manufacture of a good.

Vanderstock develops this further by saying tax on CONSUMPTION of a good will also be an excise.

It was a 4:3 majority, so a pretty close run thing. An uncharacteristically snarky judgement from Edelman J, who gave a particularly powerful dissent (including the bit I’ve screenshotted below).

Just so you know, the EV ruling of the High Court yesterday was considered by people that know about such things (like me, but not only me) an outside chance at best.
