This is nuts. The only way nobody ever pays them is a total shutdown of all imports from anywhere, which would obviously be catastrophic

Don’t forget CA and NJ! CA is probably the most important from the standpoint of the rest of the country

Yeah, I mean, I thought his argument was the obvious reading: licenses = way to regulate by who you do and don’t grant permission to, not a backdoor way to raise money by charging huge fees

Also, multiple justices have pointed out that shutting down trade with the entire world would be extreme and kind of insane, but Sauer has repeatedly said that the tariffs would work BEST if nobody ever paid them…which would mean shutting down trade with the entire world

Also, who cares if you can use tariffs as a diplomatic threat?? We use wars as a diplomatic threat, but that doesn’t mean the president can unilaterally declare war

Also, the “what if he uses tariffs as a threat to achieve policy ends and never collects them” hypothetical seems irrelevant to what powers the president has. He can use a threat of war to achieve policy ends, but that doesn’t mean declaring war is a presidential power

I think Kagan already said that if it’s even reviewable, they were grant a lot of deference, even though it’s obvious bullshit
It’s the central problem with the whole idea of using “it’s an emergency” as a limitation when that determination is solely up to the person supposedly being limited
