There is far more wrong with the Noem v Perdomo shadow docket order than one can say in a single post. But one particularly hypocritical and disingenuous piece is Justice Kavanaugh's citations Biden v Tx (twice), and US v Tx. The Supreme Court DECLINED TO STAY the lower court orders in both cases.

I waited to post until DHS actually complied (which is a sign of how bad things have gotten), but now they have. TPS for Venezuela is in fact back in place!! Through October 2026 or until further order of a court. Govt has appealed; we are in stay briefing. www.uscis.gov/humanitarian...
This from my co-counsel Jaime Diez in El Valle Tx. He went to confirm our client was still here (he is). We (also Jennifer Babaie, Paige Austin, Javier Maldonado) got a TRO in this and another case to stop imminent unlawful “deportations.” But lots of other people being expelled. @justsecurity.org

Check out my piece @justsecurity.org about yesterday's DOJ memo threatening to prosecute state officials for following sanctuary policies. TLDR: the Trump admin can't do that!! It's not a crime to follow sanctuary policies, and more generally not a crime to simply ignore ICE's demands for help.

This lawsuit is about the June 2024 asylum restriction that Biden put into effect, which was justified in part by the existence of alternate legal pathways like CBP One. Eliminating that pathway now makes this regulation less defensible. Trump will aim to replace it, exact method still unclear.
