Years ago, I was in a very similar situation, but with Bauducco strawberry wafer cookies. I was able to successfully argue my case to the IRS. The Bauducco cookie is constructed in three layers of cream, though. Not sure if the tax code treats that differently than a single-level Nilla Wafer.
