It’s really sad. I don’t think people understand how big that is. The consequences can be similar to the movie Gravity as shrapnel flies around but eventually it can take out other satellites like GPS, weather, communications, mapping, etc.

Others would disagree. While you are correct that it’s not a true BSD kernel, it apparently uses a fair amount of the BSD low level stuff. Here’s an explanation better than I could do without access to the code. Take it however you wish.

Google itself explains a number of infringement methods that have nothing to do with GA triggering unintentionally.
Google either made a series of choices to monitor people in violation of EULA or people there screw up big time repeatedly. They did it multiple ways.
