I hope Judge Graber’s closing remark shows that she has already asked all her 9th Circuit colleagues to take the case en banc — esp. because there is now a split with the 7th Circuit — and dissolve this stay. See Federal Rules of Appellate Procedure 40(b)(2)(C) & 40(c).
