Is it a timely returned indictment if the person who sought it was not a person who was authorized to do so, though? I can't imagine it would be, because then you could--in theory--extend the SoL forever by having improperly appointed people seek indictments.

Ok, so you clearly ignored where I posted above where the statute of limitations is up, and losing this indictment likely forecloses any prosecution--it isn't fixable.

*EVEN IF IT WERE*...the government still will need to find someone legally appointed to indict, which was the issue to start with.

You have it exactly backwards. As a matter of law, he is innocent unless and until a jury (or judge, if he chooses not to exercise his right to a jury trial) convicts him.

No valid indictment? As a matter of law, he's innocent.

Even with a verdict, people will still ask the same as you pose above

If there is a quicker off-ramp, it isn't reasonable that someone should have to take the crap shoot of a jury just to get to the merits.

And in this case, there may not be a second try, because the rush to get this indictment was statute of limitations based, which has now passed.

It'd be nice if there was some sort of audible cue or visual highlight that the timer is up and take it out of the refs' hands. Maybe that's hard to do in a football stadium of 60k+ than a basketball venue with a third of that.
