The real focus has to be on getting new legislation. The ECHR is one route for that, and the GLP are an effective means of pushing for that. The other necessary route is to do what we can to get Starmer and his minions out of office.

I like the Good Law Project and I try to chuck money their way every month, but the way they’ve handled this judgement - trying to act like it’s a mixed bag, rather than an utter disaster, has given people false confidence that is going to get them hurt.

That’s your decision & I respect it. But you can be terminated for disobeying that instruction, and you should be aware of that. The law is not on our side. I’m sorry.

So many people are trying gotchas like “well what if a workplace only has one set of toilets for employees and customers?”

Then the toilets have to be “single-sex” (trans exclusive), so that the employer satisfies their duties under the 1992 regs.

Yesterday was a vindication for Girlguiding and the Women’s Institute - because it proved that their lawyers were right. They wouldn’t be able to win this battle, because being trans-inclusive is - as bizzare as it is - now illegal. And that’s the government’s doing, not theirs.

I hate how much of the trans community still have their fingers in their ears and believe that the law is still on our side in a post-FWS world. We cannot fix this mess without new legislation, there is no other way out of this.

Usually I’m the one screaming “it’s not as bad as you think!” after something like this, but everybody seems to be celebrating as if this is positive. We’re in a worse position than we were yesterday & I’m pretty disappointed with the GLP for not acknowledging that.

It’s lawful to be trans-inclusive, if you have an equivalent service for both sexes.

It’s unlawful to be trans-inclusive, if you are an employer or you are a single-sex service with no direct equivalent (e.g. Girlguiding).

The two times that I’ve come the closest to death were:

i) when my parents discovered my clothes and severely mocked and interrogated me.

ii) when the shame from family led to me attempting to detransition for 6 months.

The current guidance would’ve killed me as a teen. Being able to socially transition at school, without my parents’ knowledge, was a lifeline for my mental health.

I think that in the current circumstance, until we have new legislation or an opportunity to take things to the ECHR, this is the best that they can realistically argue post-FWS. It would be very difficult to argue that FWS does not give orgs the right to exclude by so-called “biological sex”

My understanding, and I might be wrong, is that the GLP’s hopeful interpretation is that it is not unlawful to be either trans-exclusive or trans-inclusive (as the EHRC guidance claims) - except for in the case of employers where inclusion is mandated, due to Workplace Health and Safety Regs 1992

Best case: They find that the EHRC guidance was unlawful and that employers cannot ban trans people from the correct toilets.

Worst case: They say that the EHRC guidance was fine, which gives gov the go-ahead to push forwards.

Likely case: “The guidance was withdrawn so it doesn’t matter anymore”
