IMHO the low average space utilisation of 37 places per coach, 32 if you ignore the seated cars is not helpful to increase the margin either (their previous sleepers offered 36 places).
Guess if you can't run trains for months because of trackworks, pay more TAC because of detours pay more compensations because of delays it's hard to make a profit even with the latest design.

It's heartbreaking. I learned to ski in deep snow in the Lötschental. I spent a night in Blatten, in a Massenlager with a dozen ski tourers aiming to cross the Lötschenlücke to the Aletsch. The place was so breathtakingly picturesque. All gone. 1/2

You are right that this is neither improving passenger rights nor prohibiting discrimination, but this must be solved by regulation from EU. BTW looking at how passenger rights in air transport are to be weakened, I am not sure that better compensation for train delays should be a top priority now.
If DB achieves to present a working cross-european NON-DISCRIMINATORY ticket sales platform with ALL PRICES on the the base of its best-in-class search engine INCLUDING EUROPEAN SLEEPER by the end of the year - I wouldn't mind the EU to declare OSDM a possible standard. Carrots & sticks.
Certainly not the breakthrough DB tries to sell. BUT the positive aspect - it can hardly be worse than international [email protected] right now AND that EU standardization seems to exercise some pressure on the CER members to prove their promised OSDM miracle is actually working somewhere.
