How truthfully recanting can be if it keeps happening
If it is a one of instance I agree but if what is said before it true it has happened multiple times with other things. Once can happen but two of more and it gets suspicious. I d9n't follow him too much so don't know the exact things that happened. Just saying I can understand scepticism
Spouting nonsense and then recanting can only bring you so far. Especially if you are known as a person that works out every detail for your videos
I get scepticism if it happens more often. Especially as things he brought up are core terms in the whole discussion. Especially SBI being a gamergate 2 dogwhistle. It is okay to still be like: okay but do better than this.

I checked all dates for friday, saturday/sunday. Total 27 presentations (regional and pokemon ones included. Only 6 of these were worldwide and a friday. Of those 6 only 1 was a general direct in 2013 (wikipedia list, didn't check timezones).
Tbf the 35th wasn't that big either.
Definitely not just a coincidence as they could have simply done today like a normal direct. I think the only one before was when in certain areas the one from march 8/9th 2018 was broadcasted
35th got a presentation. A direct on a friday is special, but even more so: it ends just before the actual birthday date in Japan. So it isn't weird to expect announcements surrounding the anniversary in the direct. Especially as it is the longest ever.
if from those past 39 years we look at the amount of times they did presentations we only have the 30th and 35th. The 30th was included in directs with special bundles, amiibo and mario maker.

To be fair this has never happened in this way. Only wii sports had more as every console came with it. Botw had a very blvery short period of more than 100% but this rate after multiple weeks is pretty unprecedented.
Copyright is just confusing but as you said they are pretty happy suing. So I don't expect these kind of things to be done without due dilligence. The screenshot only shows fair use protects from c&d not that the owner of the original work can't use it
This is when someone makes original art. When using a copyrighted/protected character it is different. Otherwise people could just make mickey mouse movies even before the design got in public domain. As the art is then created and protected but it doesn't work like that with characters like it
Yes so technically Pokémon can c&d all fanart because a pokémon design is theirs. Fanart technically infringes on copyright so like I said it is scummy to do, but they are very likely in their right
Because of the clause and it being technically their IP with Ho-Oh being their design. They are technically not in the wrong. With how stubborn TPC is with literally everything if this was a management decision they wouldn't have reversed it
Of course it can be the case it was done maliciously but having some experience with TPC: they wouldn't have changed their stuff if it was on purpose.
With the way I think it happened is the file of the fanart was saved by an employee. Either to highlight on socials, for personal use, to show colleagues etc. That art moved somewhere in com0any folders without a marking it is fanart.

They want a relative simple hooh design and find this.
There are a 1001 reasons fan art gets added in reference materials. A likely one is that someone saved the art and someone else found it and thought it was official so it was included in the materials.

The way they responded made is very unlikely it was like: trace this fanart
Regarding fan art. Yeah it is kinda scummy they are able to copy it, but it was not on purpose here or they would have just kept it and point to the clause.
Again the ppint I was replying to was crediting the artists of cards and that Nintendo is not the deciding factor Which they did.
